Yeah, I agree that Iraq will be hard pressed to deliver a fair trial. Fortunately, Saddam's case is so cut and dry that everyone know's he's an evil tyrant, but I fear the problems will come into play when less significant members of the Baath party are tried. This whole process seems ex-post facto, in that the US is saying they will try crimes dating back to 67', but in a sense aren't the laws being created now? I mean, like it or not, a government has the right to govern itself. I suspect many individuals were given choices to either obey the Baath laws, or have their families murdered, tortured and raped ...
I'm not sure what the right thing to do in these cases are. They're victims in a sense, or an evil set of laws. Certainly, they cannot be held responsible for obey laws that existed at the time, but have since been demeeed illegal by an occupying nation, can they?
I'm not studying this situation very astutely, so perhaps they only intend to try to very high ranking officials. I doubt it, but perhaps.
